  1. What does this Privacy Policy cover?

    This policy covers the Scottish Slimmers Web and App service, which includes the scottishslimmers.com website and Scottish Slimmers App, developed by Best You (Wellbeing) Limited

  2. What personal information do we collect about you?
    1. We collect the following personal information about you when you use the service:

      First name
      Email address
      Encrypted password
      Personal profile (your age, sex, height, start weight, goal weight, activity levels and any other boxes you tick during sign up)
      Photo (if you upload this)
      IP address
      Mobile device ID

      When you pay for a subscription via the website (ScottishSlimmers.com), we use a secure payment processing gateway. The personal information you enter when making a payment falls under the relevant company's Privacy Policy. Your card payment information is not stored by Scottish Slimmers.

      When you buy a subscription via the Scottish Slimmers App, the in-App payment is processed by Apple iTunes (iOS devices) or Google Play (Android devices); we only keep a record of your payment in order to administer your membership.

    1. When you use the Scottishslimmers.com website, we use Cookies to enable you to use the site.
    2. A cookie is a small piece of data sent from our website that is stored by your web browser while you are using the service.
    3. You must allow Cookies in order for the website to work correctly.

  5. How do we use the personal information we hold about you?
    1. We use your height and weight to calculate your BMI (Body Mass Index) - this is a safety check to ensure our service is suitable for you.
    2. We require your personal profile data (age, sex, height, start weight, goal weight and activity levels) in order to calculate your Daily Checks Allowance to help you reach your goal.
    3. Your personal information is used to enable you to access and use the service. To administer your membership, it is necessary for us to send you emails relating to payments you make and your account status. These are classed as 'administration' emails and are essential to your subscription.
    4. As part of your membership to assist you in achieving your goal, we provide a series of essential starter tips by email during your first week of membership. You have the right to opt out of these at any time (see section 6).
    5. We may use information about your online browsing behaviour collected by Google Analytics to help us improve the service and your experience. Google provides a comprehensive Privacy Policy allowing you to control how your data is used.
    6. We use your personal information to process and respond to enquiries made by you by email or phone.
    7. In the event of a suspected breach of the Terms of Use relating to you or made by you, we will use your personal information to help us investigate.
    8. We may use data that has been aggregated and does not personally identify you for purposes such as reviewing sales patterns, monitoring traffic volumes and understanding food searches and consumption behaviour, in order to manage and improve the service.
  6. Do we share your personal information with anyone else?
    1. Scottish Slimmers will not pass or share your data with any other third party. The only exception would be if we are required by law to disclose information to the police, regulatory bodies or legal advisers in connection with any alleged criminal offence, legal proceedings or a suspected breach of the Terms of Use.
    2. If you visit our public Facebook Page by clicking on the 'Community' tab on the ScottishSlimmers.com website, you will be taken to the Scottish Slimmers Facebook page. You will need a Facebook account to be able view the content. It is your choice whether you use the 'Community' - if you do, this falls under Facebook's Privacy Policy
    3. Should the operation of this service be transferred to a different company in the future, the new operator would be entitled to use your personal information in a way consistent with this Privacy Policy, in order to provide a continuous service to you.
  7. How you can change your email preferences
    1. You have the right to control what we contact you about. You can set your email preferences in your Scottish Slimmers account - via the website or App.

      To update your preferences for the email communications we send you, follow the instructions below:

      Website: Sign in to your account and select 'My Account' in the top right menu. Scroll down to Marketing Preferences, select your preferences and click save.

      App: Tap on 'My Profile' in the bottom menu bar. then click on 'Communication preferences' and confirm your updates by clicking on 'Update My Preferences'

      You can also use the links in any emails you receive to manage your preferences or unsubscribe.

  8. Use of children's personal information
    1. We do not knowingly collect or store any personal information about children under the age of 16. This service sets nutritional targets based on adult requirements, which is unsuitable for children.
  9. Your information rights under the General Data Protection Regulations (GDPR)
    1. Your right to rectify information - if any of the data we hold about you is incorrect, you can correct this yourself in your account, or you can contact us and we will correct this for you within one calendar month.
    2. Your right to be forgotten - you can request that we delete or remove your personal information from our system. This will be done within one calendar month.
    3. Your right to restrict how we use your data - you can object to us using your personal information to limit the way we use it.
    4. Your right to data portability - you can request that we provide you with a file of your personal information within one calendar month.
    5. Your right to object - you can object to us using your personal information to carry out profiling.

  10. Keeping your personal information secure
    1. We take privacy and security very seriously. The service is hosted on a cloud computing platform with privacy features and end-to-end security built in.
  11. How long do we keep your personal information?
    1. If you have not used the service for 5 years your account and all personal information may be deleted from our system.
    2. If you intend to return and use the service at any point, simply log in to your account to maintain an active account.
  12. Changes to our Privacy Policy

    This policy is effective from 1 December 2023 and replaces with immediate effect the previous version. We may, from time to time, make changes to this Privacy Policy - it is your responsibility to check back regularly. If a change is important or requires your consent by law, we may email you to let you know. Any changes posted on this page become effective immediately.
